#800000;\">PARA IMPLANTA\u00c7\u00c3O DE EMPREENDIMENTOS<\/span><br \/><\/strong>\u00a0 \u00a0<strong>\u00a0a) Na implanta\u00e7\u00e3o de reservat\u00f3rios d&#8217;\u00e1gua artificiais destinado a gera\u00e7\u00e3o de energia ou abastecimento p\u00fablico, \u00e9 obrigat\u00f3ria a aquisi\u00e7\u00e3o, desapropria\u00e7\u00e3o ou institui\u00e7\u00e3o de servid\u00e3o administrativa pelo empreendedor das APPs criadas em seu entorno, conforme estabelecido no licenciamento ambiental, observando-se a faixa m\u00ednima de 30 metros e m\u00e1xima de 100 metros em \u00e1rea rural e a faixa m\u00ednima de 15 metros e m\u00e1xima de 30 metros em \u00e1rea urbana\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 5\u00ba)<\/span><\/strong><\/p><p><strong>\u00a0\u00a0\u00a0\u00a0b) Na implanta\u00e7\u00e3o de reservat\u00f3rios d\u2019\u00e1gua artificiais de que trata o caput, o empreendedor, no \u00e2mbito do licenciamento ambiental, elaborar\u00e1 Plano Ambiental de Conserva\u00e7\u00e3o e Uso do Entorno do Reservat\u00f3rio, em conformidade com termo de refer\u00eancia expedido pelo \u00f3rg\u00e3o competente do Sistema Nacional do Meio Ambiente &#8211; Sisnama, n\u00e3o podendo o uso exceder a 10% (dez por cento) do total da \u00c1rea de Preserva\u00e7\u00e3o Permanente.\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 5\u00ba \u00a7 1\u00ba)<\/span><\/strong><\/p><p><strong>\u00a0\u00a0\u00a0 c) O Plano Ambiental de Conserva\u00e7\u00e3o e Uso do Entorno de Reservat\u00f3rio Artificial, para os empreendimentos licitados a partir da vig\u00eancia desta Lei, dever\u00e1 ser apresentado ao \u00f3rg\u00e3o ambiental concomitantemente com o Plano B\u00e1sico Ambiental e aprovado at\u00e9 o in\u00edcio da opera\u00e7\u00e3o do empreendimento, n\u00e3o constituindo a sua aus\u00eancia impedimento para a expedi\u00e7\u00e3o da licen\u00e7a de instala\u00e7\u00e3o\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 5\u00ba \u00a7 2\u00ba)<\/span><\/strong><br \/><strong><br \/><\/strong><strong>4.\u00a0<span style=\"color: #800000;\">NASCENTES E OLHOS D&#8217;\u00c1GUA PERENE<\/span>S\u2013 50 m de raio no entorno de nascentes\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba, inciso IV)<\/span><\/strong><\/p><p><strong>5.\u00a0<span style=\"color: #800000;\">ENCOSTAS<\/span>\u00a0ou parte destas, com declividade superior a 45\u00b0, equivalente a 100% na linha de maior declive\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba, inciso V)<\/span><\/strong><\/p><p><strong>6.\u00a0<span style=\"color: #800000;\">RESTINGAS<\/span>, como fixadoras de dunas ou estabilizadoras de mangue\u00a0<\/strong><strong>\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba, inciso VI)<\/span><\/strong><\/p><p><strong>7.\u00a0<span style=\"color: #800000;\">MANGUEZAIS<\/span>, em toda a sua extens\u00e3o\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba, inciso VII)<\/span><\/strong><\/p><p><strong>8.\u00a0<span style=\"color: #800000;\">BORDAS DOS TABULEIROS OU CHAPADAS<\/span>, at\u00e9 a linha de ruptura do relevo, em faixa nunca inferior a 100 m em proje\u00e7\u00f5es horizontais &#8211; (<a href=\"http:\/\/ambienteduran.eng.br\/wp-content\/uploads\/2022\/08\/TABULEIRO-OU-CHAPADA.jpg\" target=\"_blank\" rel=\"noopener\">veja foto ilustrativa<\/a>)\u00a0<\/strong><strong>\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba, inciso VIII)<\/span><\/strong><\/p><p><strong>9.\u00a0<span style=\"color: #800000;\">EM ALTITUDE SUPERIOR<\/span> A 1.800 m, qualquer que seja a vegeta\u00e7\u00e3o\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba, inciso X)<\/span><\/strong><\/p><p><strong>10.\u00a0Em\u00a0<span style=\"color: #800000;\">VEREDA <\/span>a faixa marginal, em proje\u00e7\u00e3o horizontal, com largura m\u00ednima de 50 m, a partir do espa\u00e7o permanentemente brejoso e encharcado<\/strong><strong>\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba, inciso XI)<\/span><\/strong><\/p><p><strong>11.\u00a0<span style=\"color: #800000;\">TOPO DE MORROS, MONTES, MONTANHAS E SERRAS<\/span>, com altura m\u00ednima de 100 m e inclina\u00e7\u00e3o m\u00e9dia de 25\u00b0, em \u00e1reas delimitadas a partir da curva de n\u00edvel correspondente a 2\/3 da altura m\u00ednima da eleva\u00e7\u00e3o sempre em rela\u00e7\u00e3o \u00e0 base, sendo esta definida pelo plano horizontal determinado por plan\u00edcie ou espelho d\u2019\u00e1gua adjacente ou, nos relevos ondulados, pela cota do ponto de sela mais pr\u00f3ximo da eleva\u00e7\u00e3o &#8211;\u00a0(veja as ilustra\u00e7\u00f5es\u00a0&#8211; FIG. 01 &#8211;\u00a0\u00a0<a href=\"http:\/\/ambienteduran.eng.br\/wp-content\/uploads\/2022\/08\/MORROS-E-MONTANHAS.jpg\" target=\"_blank\" rel=\"noopener\">topo de morros e montanhas<\/a>\u00a0\u00a0\u00a0 &#8211;\u00a0\u00a0\u00a0 FIG. 02 &#8211;\u00a0<a href=\"http:\/\/ambienteduran.eng.br\/wp-content\/uploads\/2022\/08\/RELEVO-ONDULADO.png\" target=\"_blank\" rel=\"noopener\">relevos ondulados<\/a>)\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba, inciso IX)<\/span><\/strong><\/p><p><strong>12.\u00a0<span style=\"color: #800000;\">\u00c9 ADMITIDO<\/span>, para a pequena propriedade rural ou posse rural familiar, o plantio de culturas tempor\u00e1rias e sazonais de vazante de ciclo curto, na faixa de terra que fica exposta no per\u00edodo de vazante dos rios ou lagos, desde que n\u00e3o impliquem em supress\u00e3o de novas \u00e1reas, seja conservada a qualidade das \u00e1guas e prote\u00e7\u00e3o da fauna\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 4\u00ba \u00a7 5\u00ba)<\/span><\/strong><\/p><p><strong>13.\u00a0<span style=\"color: #800000;\">AQUICULTURA <\/span>&#8211; nos im\u00f3veis com at\u00e9 15 m\u00f3dulos fiscais, \u00e9 admitida, nas \u00e1reas que tratam nos itens 1 e 2 desta p\u00e1gina, a pr\u00e1tica da aquicultura e da infraestrutura f\u00edsica diretamente a ela associada, desde que:<\/strong>\u00a0<strong><span style=\"color: #800000;\">(Art. 4\u00ba \u00a7 6\u00ba)<\/span><\/strong><br \/><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 I &#8211; sejam adotadas pr\u00e1ticas sustent\u00e1veis de manejo de solo e \u00e1gua e de recursos h\u00eddricos, garantindo sua qualidade e quantidade, de acordo com norma dos Conselhos Estaduais do Meio Ambiente;<br \/>II &#8211; esteja de acordo com os respectivos planos de bacia ou planos de gest\u00e3o de recursos h\u00eddricos;<br \/>III &#8211; seja realizado o licenciamento pelo \u00f3rg\u00e3o ambiental competente;<br \/>IV &#8211; n\u00e3o implique em novas supress\u00f5es de vegeta\u00e7\u00e3o nativa;<br \/>V &#8211; o im\u00f3vel esteja incrito no <\/strong><br \/><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 VI &#8211;\u00a0<\/strong><strong>n\u00e3o implique em novas supress\u00f5es de vegeta\u00e7\u00e3o nativa.<\/strong><\/p><p><strong>14.\u00a0<span style=\"color: #800000;\">CONSIDERAM-SE, AINDA DE PRESERVA\u00c7\u00c3O PERMANENTE<\/span>\u00a0&#8211; quando declaradas de interesse social, por ato do Chefe do Poder Executivo, as \u00e1reas cobertas com florestas ou outras formas de vegeta\u00e7\u00e3o destinadas a uma ou mais das seguintes finalidades\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 6\u00ba)<\/span><\/strong><br \/><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 I &#8211; conter a eros\u00e3o do solo, mitigar riscos de enchentes e deslizamentos de terra e de rocha;<br \/>II &#8211; proteger \u00e1reas \u00famidas;<br \/>III &#8211; proteger v\u00e1rzeas;<br \/>IV &#8211; abrigar exemplares da fauna ou flora amea\u00e7adas de extin\u00e7\u00e3o;<br \/>V &#8211; proteger s\u00edtios de excepcional beleza ou de valor cient\u00edfico, cultural ou hist\u00f3rico;<br \/>VI &#8211; formar faixas de prote\u00e7\u00e3o ao longo de rodovias e ferrovias;<br \/>VII &#8211; assegurar condi\u00e7\u00f5es de bem-estar p\u00fablico;<br \/>VIII &#8211; auxiliar a defesa do territ\u00f3rio nacional, a crit\u00e9rio das autoridades militares;<br \/>IX &#8211; proteger \u00e1reas \u00famidas, especialmente as de import\u00e2ncia internacional.<br \/><\/strong><\/p><p><strong>15.\u00a0<span style=\"color: #800000;\">\u00c9 PERMITIDO<\/span>\u00a0o acesso de pessoas e animais \u00e0s \u00c1reas de Preserva\u00e7\u00e3o Permanente para obten\u00e7\u00e3o de \u00e1gua e para a realiza\u00e7\u00e3o de atividades de baixo impacto ambiental<\/strong><strong>\u00a0<\/strong><strong><span style=\"color: #800000;\">(Art. 9\u00ba)<\/span>.<\/strong><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ef5b63
